Agreement Common In Industry EAGAN, Minn., and TOKYO, Japan, July 5, 1994 -- Cray Research, Inc. and FUJITSU LIMITED have completed a worldwide patent cross-licensing agreement covering each company's current and future supercomputer and mainframe patents, it was announced today. Under terms of the agreement, each company is free to pursue future computer designs without fear of patent infringement claims by the other company. The companies noted that such agreements are common in the computing industry. The agreement provides both companies worldwide, royalty- free, design freedom as new systems are developed. Both companies pointed out that patented technologies are a small portion of the essential components contained within a supercomputer and that the agreement did not include most specific designs, trade secrets, and other proprietary information that differentiate each company's products. "This agreement simply ensures that neither company must defensively scour patent records while simultaneously designing new systems," said Robert Ewald, chief operating officer, supercomputing operations of Cray Research. Commenting on the agreement, Tadao Yoshihara, managing director of FUJITSU LIMITED, said "It is beneficial for both parties to avoid patent disputes and thereby establish a base of fair competition for technical development." The companies added that this agreement in no way affects or compromises their competitive positions in the supercomputing marketplace around the world.
